IBA provides subscription-based SaaS solutions. The features, functionality, and limits of your use will depend on your selected plan, as detailed on our website.

We reserve the right to:

  • Modify, update, or discontinue parts of the Services at any time.
  • Introduce new features, enhancements, or impose usage restrictions.

3. Accounts & Security

You must create an account to use certain Services.

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You agree to notify us immediately of any unauthorized access to your account.
  • We are not liable for any loss or damage arising from your failure to secure your account.

4. Subscription, Fees & Payment

  • Fees are payable in accordance with the pricing published on app.inboxagain.io at the time of purchase.
  • Subscriptions automatically renew unless cancelled before the renewal date.
  • All fees are non-refundable, except as required by law.
  • We may suspend or terminate your access if payment is not received.

5. Acceptable Use

You must not:

  • Use the Services for any unlawful, harmful, or fraudulent activity.
  • Attempt to gain unauthorized access to our systems.
  • Upload or transmit malicious code, spam, or disruptive material.
  • Resell, sublicense, or share the Services without our written consent.
  • We reserve the right to suspend or terminate accounts that breach this policy.

6. Intellectual Property

  • All intellectual property rights in the Services, software, content, trademarks, and branding remain the property of IBA or our licensors.
  • You are granted a limited, non-exclusive, non-transferable right to use the Services in accordance with these Terms.
  • You retain ownership of any data you upload, subject to our rights to use it for service provision, analytics, and legal compliance.

7. Data Protection & Privacy

  • We process personal data in accordance with the UK GDPR and Data Protection Act 2018.
  • You remain the data controller of your customer data, and IBA acts as a data processor.

8. Availability & Service Levels

  • We aim to provide a reliable and continuous service but do not guarantee uninterrupted availability.
  • Planned maintenance will be notified in advance where possible.
  • We are not responsible for downtime caused by external providers, internet issues, or events outside our reasonable control.

9. Limitation of Liability

To the fullest extent permitted by law:

  • We exclude all implied warranties, conditions, and guarantees.
  • Our total liability to you for any claims arising out of the Services is limited to the fees paid by you in the preceding 12 months.
  • We are not liable for indirect, consequential, or special damages, including loss of profits, business interruption, or data loss.

10. Termination

  • You may cancel your subscription at any time via your account settings.
  • We may suspend or terminate your account immediately if you breach these Terms or fail to pay fees.
  • Upon termination, your right to use the Services ends, but certain obligations (e.g., confidentiality, intellectual property, liability) will continue.

11. Governing Law & Jurisdiction

  • These Terms are governed by and construed in accordance with the laws of Florida and the United States of America.
  • The courts of Florida and the U.S. have exclusive jurisdiction over any disputes.
